Terms of Service

1. Acceptance of Terms

By registering for an account, logging in - whether with an email and password or through a third-party sign-in provider (Google or Discord) - or otherwise accessing or using WorldMaster RPG ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not log in to or use the Service. Our Service is intended for users aged 16 and above. By creating an account, you confirm that you are at least 16 years old. If we discover that a user is under 16, we will suspend their account and delete their data. These Terms constitute a binding agreement between you and WorldMaster RPG, operated by Tomas Jakovlevas from Vilnius, Republic of Lithuania.

2. Description of Service

WorldMaster RPG is a web-based tabletop role-playing game management platform that provides tools for creating and managing campaigns, characters, maps, and other game-related content. The Service includes real-time collaboration features, AI-assisted content generation, and file management capabilities. The Service is currently offered as a free tier. If paid tiers are introduced in the future, full pricing, billing, and cancellation terms will be published in advance.

3. User Accounts

You must create an account to use most features of the Service. You are responsible for: maintaining the confidentiality of your account credentials; all activities that occur under your account; providing accurate information when creating your account and keeping it up to date; and notifying us immediately of any unauthorised use of your account.

4. User Content

You retain full ownership of all content you create or upload to the platform, including but not limited to campaigns, characters, stories, images, locations, events, and other creative works ("Your Content"). By uploading or creating content on the Service, you grant WorldMaster RPG a non-exclusive, worldwide, royalty-free license to: store, reproduce, display, transmit, and distribute Your Content as necessary to provide the Service; create technical copies, reformatted versions, thumbnails, and cached copies for CDN delivery, backup, and performance optimisation; and process Your Content through our locally hosted AI systems at your direction when you use AI features. This license is granted solely for the purpose of operating and providing the Service to you. It terminates when you delete content or close your account, except for copies retained in backup systems (deleted within 90 days) and content previously shared with other users. We shall not use Your Content for marketing, advertising, promotional materials, or any purpose other than providing the Service to you, without your prior explicit written consent. We will never use Your Content to train, fine-tune, or improve any AI model. You are solely responsible for Your Content and must ensure it does not violate any applicable laws, infringe any third-party rights, or contain harmful, offensive, defamatory, or illegal material.

5. Chat & Real-Time Communication

The Service provides real-time chat functionality. Chat messages are transmitted through WebSocket connections and are not stored on our servers. Chat history is stored locally on your device only. You are responsible for your communications and must not use the chat feature to harass, threaten, or otherwise abuse other users.

6. Acceptable Use

You agree not to: use the Service for any unlawful purpose or in violation of any applicable law; upload harmful, offensive, defamatory, obscene, or inappropriate content; attempt to gain unauthorised access to other users' accounts or data; interfere with or disrupt the Service's infrastructure or security; use automated tools to scrape or collect data from the Service without our written permission; impersonate other users, entities, or WorldMaster RPG; circumvent any security or access control measures implemented by the Service; or use AI features to generate content that is unlawful, harmful, defamatory, or in violation of these Terms. Violation of these rules may result in suspension or termination of your account in accordance with the Suspension and Termination section.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by WorldMaster RPG and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our explicit prior written permission. This section applies solely to the platform itself and does not affect your ownership of any content you create or upload, as described in Section 4.

8. AI-Generated Content

WorldMaster RPG includes AI-powered features for content generation. These features are processed by a locally hosted language model running on our own servers. Your inputs are not sent to external AI service providers. Any content generated by AI features at your request is yours to use, edit, and incorporate into your creative works. Content you create using AI features is treated the same as any other content you create on the platform under these Terms. Note that the extent to which AI-assisted content qualifies for copyright protection may depend on the degree of your own creative contribution, as described above. However, you acknowledge the following: AI-generated content is provided "as is" without warranties of any kind - we make no guarantees about its accuracy, quality, originality, or suitability. AI-generated content may not be eligible for copyright protection under applicable law, as EU copyright law generally requires that a work reflect the author's own intellectual creation involving free and creative choices. AI outputs may inadvertently resemble existing third-party content - you are responsible for reviewing AI-generated content before use and ensuring it does not infringe third-party intellectual property rights. We are not liable for any claims arising from your use of AI-generated content.

9. File Uploads

The Service allows you to upload files such as images and documents. You retain full ownership of all files you upload. We will not use your uploaded files for marketing, promotional, or any purpose other than providing the Service to you. You are responsible for ensuring you have the necessary rights to upload any files. We reserve the right to remove files that violate these Terms. Storage limits may apply based on your account tier.

10. Digital Services Act - Notice and Action

If you believe that content on the platform infringes your intellectual property rights or violates applicable law, you may submit a notice to us through the application's feedback system. We will review notices and take appropriate action in accordance with our obligations under the Digital Services Act (Regulation (EU) 2022/2065).

11. Suspension and Termination

We may suspend or terminate your account if you materially breach these Terms, including (but not limited to): uploading unlawful content, attempting to compromise the security of the Service, or abusing other users. Before terminating your account, we will: (1) notify you of the alleged breach and provide a reasonable opportunity to remedy it (except where the breach is so serious that immediate action is required, such as illegal content or a security threat); (2) give you at least 30 days' written notice before any non-breach-related termination (e.g., service discontinuation); (3) provide a clear statement of reasons for any suspension or termination; and (4) inform you of your right to appeal the decision through our feedback system. You may delete your account at any time through your account settings. Upon deletion, your access to the Service ceases and your data is deleted in accordance with our Privacy Policy (within 30 days). Upon termination (whether by you or by us), you will have 30 days to request export of your content by contacting us at [email protected] or through the feedback system. We will provide your content in a standard, machine-readable format at no charge within a reasonable timeframe.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for loss of data or content resulting from circumstances outside our reasonable control, such as force majeure events, third-party service outages, or your own actions. This does not limit any rights you may have under applicable consumer protection law regarding the conformity of the Service. Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or relating to the Service shall not exceed €100. This limitation does not apply to: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under Lithuanian law or applicable EU consumer protection law. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, except where such exclusion is prohibited by applicable law.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the jurisdiction of the courts of the Republic of Lithuania. However, if you are a consumer resident in another EU member state, this choice of law does not deprive you of the mandatory consumer protection rights available under the laws of your country of residence. You may also bring proceedings in the courts of your country of residence. For informal dispute resolution, we encourage you to contact us first through the application's feedback system. The European Commission also provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may modify these Terms of Service from time to time. If we make changes that negatively affect your use of the Service, we will: (1) notify you through the application at least 30 days before the changes take effect; (2) clearly describe what has changed and why; and (3) give you the right to terminate your account free of charge within that 30-day period if you do not accept the changes. Your continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms.
